TribeCalendar is a website and service to connect global retreats, festivals, properties and facilitators with people looking for these opportunities to enable personal and spiritual growth.
The services are accessible at www.TribeCalendar.org (Site).
By using the Site or Services, you agree to comply with these Terms and Conditions and to be legally bound by them, whether you become Owner or Guest. Any use of the Site is governed by the Terms.
TribeCalendar offers a platform that helps connect individuals providing retreat, festivals, properties and facilitation services with those wishing to access these services. TribeCalendar is not a party to any agreement between these individuals. All dealings are solely between the respective parties and TribeCalendar makes no representations and warranties on behalf of any Users (including but not limited to the accuracy, completeness, cost, quality, or timeliness of any goods or services provided by any Owner) and will have no liability for any interactions between Owners and Guests.
Notwithstanding the foregoing, TribeCalendar serves as the limited authorised agent of Owners for the purpose of accepting payments from individuals including Guests on behalf of Owners, and is responsible for transmitting such payments to the Owners. Each Owner hereby appoints TribeCalendar as the Owner's limited agent solely for the purpose of collecting payments made by individuals and Guests on behalf of the Owner.
TribeCalendar has no control over and does not guarantee the existence, quality, safety, or legality of any goods or services posted by Owners on the Site; the truth or accuracy of any advertisements; the ability of Owners to sell goods or services; the ability of Guests to pay for any goods or services. TribeCalendar does not warrant or guarantee that any goods or services offered through the Service will meet a Guest's requirements.
TribeCalendar does not monitor the Owners and Guests and disclaims all liability in this regard.
TribeCalendar support does not constitute a guarantee that your question or problem will be solved but only a commitment from TribeCalendar to try to provide you with helpful information.
We reserve the right, at our sole discretion, to change or modify portions of these Terms of Service at any time. Any changes will be posted on this page, with the date of the last revision indicated at the top of the page. Your continued use of the services after changes are posted constitutes your acceptance of the new Terms of Service. It is your responsibility to review these Terms of Service periodically for any changes.
You must be at least 18 years old to access or use our services. By using the Site or Services you expressly warrant that you are an adult over 18 years old.
TribeCalendar does not warranty any listing or Service. You understand that the Materials on the Site are for information only and in the responsibility of Owners and Guests.
You acknowledge that in case you would seek any legal remedy for actions or omissions of Owners, or any third parties, you will not claim any liability against TribeCalendar.
In no event shall TribeCalendar be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our services or platform.
TribeCalendar may offer the opportunity to purchase products and services from third parties. You acknowledge that such products and services are offered and sold to you by one or more third parties. For more information, please refer to the applicable third party's terms of sale and privacy policy that are presented as part of the checkout process.
5.1 You have sole responsibility when interacting with other Users. Our Services provide a platform for Users to book services and communicate with one another. TribeCalendar is not a party to, has no involvement or interest in, makes no representations or warranties as to, and has no responsibility or liability with respect to any communications, transactions, interactions, disputes or any relations whatsoever between you and any other Users, person or organisation. You are solely responsible for your interactions with other Users of our Services. We reserve the right, but have no obligation, to monitor interactions between you and other Users of our Services.
5.2 Identity Verification. We cannot and do not confirm each User's identity. You are solely responsible for determining the identity and suitability of others with whom you may interact through our Services. TribeCalendar does not represent or warrant that our tools are sufficient to determine whether it is appropriate for you to interact with another User. Further, we do not endorse any persons who use or register for our Services. We do not investigate or verify any member's reputation, conduct, morality, criminal background, or any information users may submit to the Services.
When registering as an Owner, you agree and confirm that:

As part of your listing, you are required to upload a photo of your service. When doing so:
TribeCalendar will remove or edit your listing if we believe (in our sole discretion) that it infringes or violates another person's rights or any laws in any country.
You may be required to register with TribeCalendar in order to access and use certain features of the Services.
When registering as a Guest, you agree and confirm that:

TribeCalendar reserves the right to remove and terminate any account without warning. TribeCalendar reserves the right to refuse any order placed by you.
TribeCalendar advises after booking a service through the Site, that you should wait for confirmation directly from the Owner before booking any air travel or related arrangements. This includes but is not limited to providing the Owner with any medical or health information they may require before confirming your space on a retreat.
You must be tolerant and be sympathetic with any rules set by the Owner and service.
By using the Site and Service, you agree that you are solely responsible for compliance with any law, rule, regulation, that may apply to your relationship with any Owner, Guest or any third party. You acknowledge that you will not:
8.1 International travel. As a User you have the responsibility for the following: you meet all requirements of foreign entry, and your necessary documents for travel (passports, visa, and others) are valid and organised for foreign entry.
8.2 Health. You are encouraged to consult with your doctor for any necessary or recommended inoculations prior to your travel. You have responsibility for the following: taking any and all recommended medications, receiving the required inoculations, meeting entry requirements for health, and following medical advice given for your travel.
8.3 Risk. We help you book events in other countries, but this does not represent or warrant that travel to these areas is risk-free or even advised. We are not liable for any losses or damages that may occur or result from travelling to or through any locations.
TribeCalendar reserves the right, without prior notice and at any time, (i) to remove or disable access to the Site or Services at its sole discretion, in case of violation of the Terms; (ii) to investigate and prosecute any violation of the Terms; (iii) to disclose any of your information if required to do so by law.
You are solely responsible for video, images, information, data, text, music, sound, photographs, graphics, messages, or other Materials that you upload, post, publish or display (hereinafter, "upload") or email or otherwise use via the Service.
TribeCalendar reserves the right to investigate and take appropriate legal action against anyone who, in TribeCalendar's sole discretion, violates this provision, including without limitation, removing the offending Materials from the Site, suspending or terminating the account of such violators, and reporting you to the law enforcement authorities.
You agree not to use the service to post, display or share Materials that: (i) infringes the intellectual property or other proprietary rights of any party; (j) contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (k) poses or creates a privacy or security risk to any person; (l) constitutes unsolicited or unauthorised advertising, promotional materials, commercial activities and/or sales, "junk mail," "spam," "chain letters," "pyramid schemes," "contests," "sweepstakes," or any other form of solicitation; (m) is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libellous, invasive of another's privacy, hateful racially, ethnically or otherwise objectionable; or (n) in the sole judgement of TribeCalendar, is objectionable or which restricts or inhibits any other person from using or enjoying the Service, or which may expose TribeCalendar or its users to any harm or liability of any type.
Separate and apart from User Materials, we welcome questions, comments, suggestions and ideas about TribeCalendar and our Services. If you provide a Submission, whether by email or otherwise, you agree that it is non-confidential (unless TribeCalendar states otherwise in writing) and shall become the sole property of TribeCalendar. TribeCalendar shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of Submissions for any purpose, commercial or otherwise. You acknowledge that TribeCalendar is not obligated to provide acknowledgment or compensation to you in exchange for Submissions.
In using our Services, you may be exposed to content from other members or third parties ("Third-Party Content"), either on our Services or through links to third-party websites. We do not control, endorse or adopt any Third-Party Content and shall have no responsibility for Third-Party Content, including material that may be misleading, incomplete, erroneous, offensive, indecent or otherwise objectionable. You must evaluate, and bear, all risks associated with Third-Party Content, including without limitation, profiles of other Users of our Services.
If you interact with anyone through our Services who you feel is acting or has acted inappropriately, including but not limited to offensive, violent or sexually inappropriate behaviour, who steals from you or engages in any other disturbing conduct, we strongly encourage you to immediately report such person to the appropriate authorities and then to TribeCalendar. Please note that although we encourage you to report misconduct, we are not responsible or liable for our members' actions, and we are not obligated to take any action.
You acknowledge that TribeCalendar is not, in any way, responsible for guaranteeing the safety of any Users or any person associated with them.
TribeCalendar reserves the right to ask for a mandatory ID check on your account.
If and as permitted by applicable law, we may, but have no obligation, to ask you to provide identification or other information and undertake checks designed to help verify your identity or background.
We do not warrant that verification, identity or background checks conducted on Users will identify past misconduct or prevent future misconduct. Any references to a User being "verified" (or similar language) indicate only that the User has completed a relevant verification or identification process, and nothing else.
By using the Site and Service you agree that TribeCalendar Data Protection policy governs TribeCalendar collection and use of your personal data and information.
If you breach these Terms or any other policies or community standards we have, we may, in our discretion and at any time:
(a) terminate your access to our Services;
(b) deactivate or delete your account and all related information and files in such account; and/or
(c) bar your access to any of such files or Services.
In any of these instances, you are not permitted to register for another TribeCalendar account without our prior written permission.
When you make a booking, you agree to pay the cost of the offer, including any charges and taxes that may apply.
Obvious errors and misprints are not binding. For example: if you book a service that was mistakenly offered for US$1, we may simply cancel that offer and refund anything you've paid.
16.1 Payment. We will be responsible for managing your payment and ensuring the completion of your transaction with the Owner. In this case, your payment constitutes final settlement of the 'due and payable' price. Your payment may be taken or pre-authorised when you book your Service, and it may be non-refundable. So before you book, please check the Owner's Upfront Payment and Cancellation policy, which we don't influence and aren't responsible for. If you know of or suspect any fraud or unauthorised use of your Payment Method, please contact your payment provider, who may cover any resulting charges, possibly minus an excess.
We will store your Payment Method details for future transactions after collecting your consent.
16.2 Refunds. If you cancel a Booking or don't show up, any cancellation/no-show fee and any refund will depend on the Owner's cancellation/no-show policy. Some Services can't be cancelled for free, while others can only be cancelled for free before a deadline.
16.3 Default Currency. All fees due under this agreement will be paid in U.S. Dollars.
As an Owner, you may agree to pay a pre-selected percentage of the money you receive from purchases made by Users of your goods and services through the Site, and you will pay TribeCalendar a percentage of each such transaction, as set forth in further detail in the payment plan section of your Agreement. If you dispute any charges by TribeCalendar you must let TribeCalendar know within thirty (30) days after the date that TribeCalendar initiated the charge.
17.1 Fee changes. TribeCalendar reserve the right to change fees. If TribeCalendar does change fees, TribeCalendar will provide notice of the change in an email to you at least 30 days before the change is to take effect. Your continued use of the Service after the price change or fee adjustments becomes effective constitutes your agreement to pay the changed amount.
17.2 Taxes. All Fees and other amounts payable by Users under this Agreement are exclusive of taxes and similar assessments. Commercial User is responsible for all taxes, duties, and charges of any kind imposed by any federal, provincial, territorial, or local governmental entity on any amounts payable by Users hereunder.
17.3 Payment Processor. As part of the Services, Users receive payment processing services and are subject to the Terms of Service for the respective Payment Processor. By accepting these Terms of Service and operating as a User of TribeCalendar, you agree to be bound by the Payment Processor Terms of Service, as the same may be modified by the Payment Processor from time to time. As a condition of TribeCalendar enabling payment processing services through the Payment Processor, you agree to provide TribeCalendar with accurate and complete information about you and your business, and you authorise TribeCalendar to share it and any transaction information related to your use of the payment processing services provided by the Payment Processor.
17.4 Payout policy. Initial and final payment percentages will be determined and agreed to in your Agreement with TribeCalendar. TribeCalendar reserves the right to terminate any payment processing agreement or temporarily hold payout funds for any reason.
17.5 Additional fees. TribeCalendar reserves the right to deduct any owed fees related to transactions, chargebacks, use of international credit cards, or other activities from your account prior to determining payout eligibility.
You hereby represent and warrant that you have the full power and authority to enter into and perform under these Terms. If you are using our Services on behalf of any entity, you represent and warrant that you are authorised to accept these Terms on such entity's behalf.
You hereby represent and warrant that you will use our Services in a manner consistent with any and all applicable local, state, national and international laws and regulations.
You are solely responsible for determining whether you have complied with travel restrictions to and from certain countries.
You hereby represent and warrant that you will not use the Services if the laws of your country prohibit you from doing so in accordance with these Terms (for example, if you are not allowed to provide the types of personal information that we require or if you are prohibited from participating in certain Internet activity). By using the Services, you represent and warrant that such use will not violate, or cause us to violate, the laws of your country.
Commercial User may not assign any of its rights or delegate any of its obligations hereunder, in each case whether voluntarily, involuntarily, by operation of law or otherwise, without the prior written consent of TribeCalendar, which consent shall not be unreasonably withheld, conditioned, or delayed. Any purported assignment or delegation in violation of this Section will be null and void. No assignment or delegation will relieve the assigning or delegating Party of any of its obligations hereunder. This Agreement is binding upon and inures to the benefit of the Parties and their respective permitted successors and assigns.
IF YOU USE OUR SERVICES, YOU DO SO AT YOUR SOLE RISK. OUR SERVICES ARE PROVIDED ON AN "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM, AND YOU WAIVE, ALL OTHER WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND THE SERVICES, INCLUDING THE INFORMATION, CONTENT AND MATERIALS CONTAINED THEREIN.
WE DO NOT REPRESENT OR WARRANT THAT (A) OUR SERVICES WILL MEET YOUR REQUIREMENTS; (B) OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) ANY INFORMATION THAT YOU MAY OBTAIN THROUGH OUR SERVICES WILL BE ACCURATE OR RELIABLE; (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH OUR SERVICES WILL MEET YOUR EXPECTATIONS; (E) ANY INFORMATION YOU PROVIDE OR WE COLLECT WILL NOT BE DISCLOSED TO THIRD PARTIES; OR (F) ANY ERRORS IN ANY DATA OR SOFTWARE WILL BE CORRECTED.
IF YOU ACCESS OR TRANSMIT ANY CONTENT THROUGH THE USE OF OUR SERVICES, YOU DO SO AT YOUR OWN DISCRETION AND YOUR SOLE RISK. YOU ARE SOLELY RESPONSIBLE FOR ANY LOSS OR DAMAGE ARISING OUT OF SUCH ACCESS OR TRANSMISSION; THEREFORE, YOU SHOULD USE INDUSTRY-RECOGNIZED SOFTWARE TO DETECT AND DISINFECT VIRUSES FROM ANY DOWNLOAD.
NO DATA, INFORMATION OR ADVICE OBTAINED BY YOU IN ORAL OR WRITTEN FORM FROM US OR THROUGH OR FROM OUR SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
You shall defend, indemnify and hold harmless TribeCalendar (and each of our officers, directors, members, employees, agents and affiliates) from any claim, demand, action, damage, loss, cost or expense, including without limitation reasonable attorneys' fees, arising out of or relating to (a) your use of our Services; (b) any Member Content or Submissions you provide; (c) your violation of these Terms; (d) your violation of any rights of another; or (e) your conduct in connection with the Services. Further, if you are using the Services on behalf of any entity, you represent and warrant that such entity agrees to indemnify you and TribeCalendar for violations of these Terms in accordance with this Section. If you are obligated to indemnify us, we will have the right, in our sole and unfettered discretion, to control any action or proceeding and determine whether we wish to settle it, and if so, on what terms.
In no event shall either Party be liable to the other Party, or be deemed to have breached this Agreement, for any failure or delay in performing its obligations under this Agreement, if and to the extent such failure or delay is caused by any circumstances beyond such Party's reasonable control, including but not limited to acts of God, epidemics, pandemics, including the 2019 novel coronavirus disease (COVID-19) pandemic, flood, fire, earthquake, explosion, war, terrorism, invasion, riot or other civil unrest, strikes, labour stoppages or slowdowns or other industrial disturbances, or passage of law or any action taken by a governmental or public authority, including imposing an embargo.
From time to time during the Term, either Party may disclose or make available to the other Party information about its business affairs, products, confidential intellectual property, trade secrets, third-party confidential information, and other sensitive or proprietary information, whether orally or in written, electronic, or other form or media, and whether or not marked, designated, or otherwise identified as "confidential" (collectively, "Confidential Information"). Confidential Information does not include information that at the time of disclosure is: (a) in the public domain; (b) known to the receiving Party at the time of disclosure; (c) rightfully obtained by the receiving Party on a non-confidential basis from a third party; or (d) independently developed by the receiving Party. The receiving Party shall not disclose the disclosing Party's Confidential Information to any person or entity, except to the receiving Party's employees who have a need to know the Confidential Information for the receiving Party to exercise its rights or perform its obligations hereunder. Notwithstanding the foregoing, each Party may disclose Confidential Information to the limited extent required (i) in order to comply with the order of a court or other governmental body, or as otherwise necessary to comply with applicable Law, provided that the Party making the disclosure pursuant to the order shall first have given written notice to the other Party and made a reasonable effort to obtain a protective order; or (ii) to establish a Party's rights under this Agreement, including to make required court filings. On the expiration or termination of the Agreement, the receiving Party shall promptly return to the disclosing Party all copies, whether in written, electronic, or other form or media, of the disclosing Party's Confidential Information, or destroy all such copies and certify in writing to the disclosing Party that such Confidential Information has been destroyed. Each Party's obligations of non-disclosure with regard to Confidential Information are effective as of the Effective Date and will expire five (5) years from the date first disclosed to the receiving Party; provided, however, with respect to any Confidential Information that constitutes a trade secret (as determined under applicable Law), such obligations of non-disclosure will survive the termination or expiration of this Agreement for as long as such Confidential Information remains subject to trade secret protection under applicable Law.
TribeCalendar may contain links or references to third party websites. Any such links are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any content, material or information contained in them. The display of any link or reference to any third party website does not mean that we endorse that website, product or service.
TribeCalendar may retract or change their Services at any time without notice or refund.
Our failure or delay in exercising any right, power or privilege under these Terms shall not operate as a waiver thereof.
The invalidity or unenforceability of these Terms shall not affect the validity or enforceability of any other of these Terms, all of which shall remain in full force and effect.
We may modify the Terms from time to time. You agree to be bound by any changes made by us. It is your responsibility to check the Terms from time to time to verify such changes.
This Agreement shall be governed by and construed in accordance with the laws of State/Country in future registered company location of TribeCalendar. We make no representation that the services or products offered in the site are appropriate or available for use in any particular location. To access or use the Services, you must be able to form a binding contract with TribeCalendar and you must not be prohibited from receiving the Services under Estonian law or any other applicable laws.
